Welcome to FirstArive. These Terms and Conditions (“Terms”) govern your use of the FirstArive website
and services provided by FirstArive LLC (“we,” “our,” or “us”). By accessing or using our services, you
agree to these Terms. If you do not agree, please do not use our platform.

  1. Overview of Services
    FirstArive is a social networking and community engagement platform offering:
    • An event space where hosts can post and manage free or paid get-togethers for students
    • A social networking space for students and host communities
    • A digital marketplace to support community interactions and commerce
    • Information of local businesses (grocery stores, restaurants, transport, healthcare, schools, etc.)
    • Third-party integrated services for secure payments and messaging

2. Eligibility and User Accounts

  • Users must be 18 years or older and capable of forming a legally binding agreement.
  •  You agree to provide accurate, complete, and up-to-date information on our platform.
  • You are responsible for all activities that occur under your account.
  • You are responsible for keeping your login credentials confidential and must notify us of any
    unauthorized use.

3. Platform Conduct
Users agree to:

  • Post only legal, accurate, and respectful content
  • No harassment, hate speech, or inappropriate conduct
  • Not impersonate another person or misrepresent affiliation
  • Not uploading viruses, malware, or engaging in phishing or cyber attacks
    We reserve the right to suspend or terminate accounts for violations.

4. Event and Marketplace Usage

  • Hosts can create free or paid events subject to FirstArive’s approval and guidelines
  • FirstArive is not responsible for get together events quality, safety, or outcomes. All transactions
    related to events are subject to these terms and any additional guidelines posted by the host.
  • Marketplace transactions are peer-to-peer. FirstArive does not guarantee product or service
    quality or enforce delivery or payment
  • Users must comply with local, state, and federal laws when posting or transacting

5. Payments

  • All payments are processed by vetted third-party providers (e.g., Stripe)
  • FirstArive does not store credit card or bank information
  • Users are responsible for ensuring payment accuracy and agreeing to the applicable third-party
    policies and terms and conditions
  • A service charge is applied to paid dinners/meals:
    o Guest Fee: 9.78% of the total amount
    o Host Fee: 2.67% of the total amount
  • FirstArive does not collect, withhold, or remit taxes on behalf of users. Users are solely
    responsible for reporting and paying any applicable taxes.
  • All purchases and membership fees are non-refundable.
  • All subscriptions automatically renew at the end of each billing period unless
    cancelled by the user through their account settings. In case of mid-period
    cancellation prorated fee will be charged

6. Cybersecurity and Personal Data Protection
We maintain a secure platform using industry best practices:

  • HTTPS encryption for data transmission
  • Password hashing and multi-factor authentication
  • Routine vulnerability scanning, monitoring, and access controls
  • Our platform may contain links to third-party websites. We do not control or endorse these sites
    and are not responsible for their content, terms, or practices.
  • Users are advised to:
    • Use strong, unique passwords
    • Avoid sharing login details
    • Report suspicious activity to support@firstarive.com

7. Fraud and Scam Prevention
We proactively combat fraud through:

  • Real-time monitoring for suspicious behavior
  • Warning systems for fraudulent content or payment manipulation through third-party policies
    and procedures
  • We encourage users to:
    • Be cautious when communicating with unknown parties
    • Avoid clicking unverified links or downloading attachments
    • Report scams or fake listings promptly

8. Intellectual Property

All intellectual property on FirstArive belongs to FirstArive LLC or its licensors. Users retain ownership of
their content but grant FirstArive a global, royalty-free license to use it within the platform.

9. Limitation of Liability

To the fullest extent permitted by law, FirstArive is not liable for any indirect, incidental, special, or
consequential damages arising from your use of the platform. FirstArive shall not be liable for:

  • Indirect, incidental, or consequential damages
  • User misconduct or third-party interactions
  • Unauthorized access or data breaches beyond our reasonable control

10. Indemnification

  • You agree to indemnify and hold harmless FirstArive LLC, its officers, employees, and affiliates
    from any claims, damages, or liabilities resulting from your use of the platform.

11. Termination
We may suspend or terminate your access to FirstArive for any reason, including violation of these
Terms. Upon termination, your rights to use the platform cease immediately. We may suspend or
terminate accounts for:

  • Breach of Terms
  • Legal violations
  • Security threats or misuse of platform resources

12. Disclaimer of Warranties
FirstArive provides its services “as is” without warranties of any kind. We do not guarantee
uninterrupted or error-free service.

13. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law provisions.

14. Amendments

We reserve the right to update these Terms at any time. Changes take effect upon posting.

15. Get-Together Events Guidelines

Purpose: FirstArive’s get-together events are designed to foster cultural exchange, build community,
and create a safe, welcoming space for students and local hosts to connect.

Guidelines for Hosts

  1. Event Approval and Posting
    • All events must be submitted via the FirstArive platform.
    • Events should include clear details: date, time, location, purpose, expected number of
      participants, and any associated costs.
    • Paid events must include transparent pricing and acceptable methods.
  2. Safety and Inclusivity
    • Hosts are responsible for ensuring the physical and emotional safety of participants.
    • Events must be inclusive and respectful of all cultural, religious, and personal
      backgrounds.
    • Discriminatory behavior, harassment, or exploitation will result in permanent removal
      from the platform.
  3. Legal Compliance
    • Events must comply with local laws and venue regulations (e.g., capacity limits, permits,
      alcohol policies).
    • Hosts must avoid any illegal activities or content (e.g., unlicensed services, unsafe food
      handling and preparation).
  4. Cancellation and Communication
    • Inform participants at least 24 hours in advance in case of cancellations or major
      changes. Not cancelling the event at least 24 hours in advance will result in no refund.
    • Maintain open communication with attendees before and during the event.
  5. Liability
    • Hosts are fully responsible for the safety, conduct, and any liabilities arising from their
      events.
    • FirstArive does not cover insurance or assume liability for injuries, damages, or disputes
      during events.

Guidelines for Students

  1. Respect and Participation
    • Attend events with a spirit of openness, respect, and curiosity.
    • Respect host rules, cultural norms, and the space provided.
    • Avoid disruptive behavior or actions that may make others feel unsafe.
  2. Registration and Attendance
    • Sign up only for events you plan to attend and cancel early if you cannot make it.
    • Do not share event locations publicly or bring unregistered guests without host
      permission.
  3. Safety and Awareness
    • Let a friend know where you are going, especially for private or home-based events.
    • Report any inappropriate behavior or unsafe conditions immediately to 911.
  4. Feedback
    • Provide constructive feedback after the event to help improve future experiences.

Code of Conduct (Applies to All Participants)

  • Be kind, courteous, and respectful at all times.
  • No bullying, harassment, or hate speech.
  • No solicitation, promotion, or political campaigning unless explicitly allowed.
  • Violation of these guidelines may result in suspension or permanent removal from FirstArive.
